2257 Record-Keeping Policy

Solutionize Tech, LLC (Delaware, USA), operating the Finsta platform ("Finsta")

1. Purpose and scope

This Policy explains how the record-keeping requirements of 18 U.S.C. § 2257 and § 2257A, and the regulations at 28 C.F.R. Part 75, apply to content on Finsta. It forms part of the Standards together with the Terms & Conditions, the Age & Identity Verification Policy, the Co-Creator Verification Policy, the Creator Consent & Media License, the Prohibited Content and Activity List, the Content Moderation Policy and the Complaints & Content Removal Policy.

2. Where sexually explicit content can appear

Every publicly visible surface on Finsta is non-explicit. Profile pictures, banners, display names, bios, preview images and listing thumbnails must not contain sexually explicit material and are screened before publication. Sexually explicit material can exist only inside 1:1 Interactions between a creator and an individual user. There is no public feed, gallery or browse surface of explicit material anywhere on Finsta. This is set out in Section 2.5 of our Content Moderation Policy.

3. Producers and their records

Each creator produces the content they create and share on Finsta. A creator who is a producer for the purposes of 18 U.S.C. § 2257 and § 2257A, or any comparable law, is responsible for their own records, labelling and custodian obligations, as set out in Section 7 of our Terms & Conditions.

4. Who may appear

Every person who appears in content on Finsta must be 18 or over. No one other than the creator who holds the account may appear in that creator's content, or on the creator's side of an Interaction, unless they have first been verified as a co-creator under our Co-Creator Verification Policy. Until co-creator verification is available, no one other than the account holder may appear.

5. Age and identity verification

Before any funds are released to a creator, their age and identity are verified by our payout provider, as set out in our Age & Identity Verification Policy.

6. Custodian of records

Finsta has appointed the following custodian of records for the records required by 28 C.F.R. Part 75:

Finsta is introducing identity verification for every creator and co-creator before they can appear in sexually explicit content. Records are lodged with the custodian as each creator and co-creator completes that verification. Until a creator's records are lodged, the creator remains responsible for keeping their own records under Section 3.

7. Reporting and enforcement

Any depiction of a minor, and any non-consensual content, is prohibited absolutely under our Prohibited Content and Activity List. Breach results in content removal, account suspension or termination, withholding or forfeiture of related earnings, and reporting to law enforcement where required. Anyone can report content through the Report User option in the app or by emailing admin@solutionize.tech. Intimate imagery published without consent is removed under the 48-hour process in our Complaints & Content Removal Policy.

8. Governance

This Policy is owned by Finsta's compliance function (admin@solutionize.tech) and is reviewed at least annually and whenever the law, the card-network rules or the product materially change.
