Creator Consent & Media License

1) Visibility & Safety Context (Summary)

• No public age-restricted content: Age-restricted content never appears on public-facing pages (Explore, public profiles, chat previews). Non-restricted profile elements may appear publicly (e.g., avatar, banner) if compliant with our Standards.
• Blur-gating: Age-restricted product thumbnails use blur protection; full content is viewable only after purchase.
• Pre-screening: All Uploaded Content is subject to automated screening before publication. Screening is applied to every upload, but no screening system detects every violation. Screening assigns signals and categories to content. Where particular signals or categories are present, screening may result in automated action, including restricting or removing the content and suspending or banning the account. An internal reviewer may additionally examine flagged content.

2) The Consent & License You Grant

You own your Media. This is a licence, not a transfer. You keep all ownership and copyright in your Media and your Likeness. Finsta acquires no ownership interest in anything you upload. Everything below is permission to do specific things with your Media so that the Platform can operate, and nothing more.

By checking the required boxes and clicking "I agree to the Creator Consent & Media License" you grant Finsta the following permissions within the Platform and for compliance/safety:

2.1 Scope (Required)

A worldwide, non-exclusive, non-transferable, royalty-free license, exercisable through service providers acting on our behalf, over your images, video, audio, and text that you upload (the "Media") and your name, display name/handle, likeness, and voice (your "Likeness") as they appear in the Media. The rights you grant are not the same for all Media: they depend on what the material is:

• Non-restricted profile elements — your display name/handle, avatar, banner and bio text, which must be non-explicit under our Standards: to host, store, transcode, analyze (for safety/moderation), otherwise process, and display them inside the Platform and on Finsta's own marketing websites.
• Age-restricted Media: to host, store, encrypt, transcode, analyze (for safety/moderation), otherwise process, and transmit it to the individual recipient who obtains it through the Platform (including its blurred preview to that recipient). Finsta will not display, publicly display or publicly perform age-restricted Media on any public or general-access surface, and will not use it in marketing of any kind.
• Your Likeness: only so far as is needed to exercise the two rights above, and, off-platform, only if you separately opt in under Section 2.5.

and in each case solely to:

• operate and provide the Platform (including previews, product pages, in-app discovery/placement, and delivery to purchasers/recipients),
• enforce our Standards (including automated screening and, where warranted, internal review and investigation), and
• comply with legal, card-brand, and partner obligations.

These permissions are a licence only. They do not transfer ownership, do not permit Finsta to sell or sub-license your Media to any third party other than service providers acting on our behalf, and end when your Media is removed from the Platform, subject to any retention we are legally required to make.

2.2 Visibility Clarification

Public areas: Only non-restricted profile elements (e.g., avatar, banner, bio text) may appear publicly if compliant.

Gated areas: Age-restricted Media and its previews are blur-gated inside Finsta and reach only the recipient who obtains the Media through the Platform. Finsta does not put age-restricted Media on any public or general-access surface.

2.3 Duration

This license lasts while your account or Media remains on the Platform and, following deletion or closure, for the period reasonably necessary to: (i) complete ongoing transactions, chargeback/fraud reviews, or investigations; (ii) meet legal retention/audit duties; and (iii) maintain backups.

2.4 Promotions Inside the Platform (Required)

You permit Finsta to use your non-restricted profile elements (display name/handle, avatar, banner) and compliant product thumbnails inside the Platform for in-app discovery and search results.

How placement actually works, so there is no confusion: in-app Explore ranking is algorithmic — profiles are ordered by automated ranking signals, and Finsta does not hand-pick what appears in Explore. Separately, a small number of non-explicit profiles are hand-selected by Finsta for display on Finsta's public marketing websites. Only non-restricted profile elements are used in that hand-selected display, and being hand-selected is not a promise of placement, earnings or continued display.

2.5 Optional: Off-Platform Marketing (Separate Box; Optional)

If you choose to opt in, you grant Finsta permission to use your non-restricted profile elements and selected non-restricted Media off-platform (e.g., Finsta website landing pages, social channels, paid ads) to promote you or the Platform. You can withdraw this optional consent at any time in your app Settings or by contacting us (see Section 23, Notices & Contact, in our Terms & Conditions).

Limits that apply whether or not you opt in: Finsta will not use sexually explicit or age-restricted Media in off-platform marketing of any kind. Marketing creative, landing pages and the search terms and keywords used to promote the Platform will not suggest minors, non-consent, or any other category listed in our Prohibited Content & Activity List.

Finsta's advertising is US-focused. Finsta will not direct off-platform marketing to any jurisdiction where the Platform's content or services are unlawful, and will not knowingly place advertising on surfaces targeted at such a jurisdiction.

3) Your Representations & Warranties (Required)

You confirm that:

• You are at least 18 (and of majority age in your location) and will complete the identity and age verification carried out by our a third-party provider before any funds are released to you, as set out in our Age & Identity Verification Policy. That verification is operated by the third party under its own terms and privacy policy, and may include a facial scan or other checks determined by that provider.
• You are the person depicted in the Media you upload, or, for every other person depicted, you have verified that person's age by inspecting a government-issued photo ID, hold that person's written release, and retain both. You must produce those records to Finsta within five (5) business days of a request. Media depicting a person whose age or consent cannot be evidenced on request is removed, related payouts are frozen, and the account is subject to termination. You remain the primary holder of those records; Finsta retains your attestation and any documentation you provide (see our Age & Identity Verification Policy).
• The Media is lawful, consensual, and compliant with Finsta's Standards as outlined in our Terms & Conditions, which you accepted upon sign-up (no CSAM, non-consensual content, trafficking, or other material listed in our Prohibited Content & Activity List).
• You are responsible for your own conduct in an Interaction and will take reasonable steps to satisfy yourself that each Interaction is lawful, as set out in Section 5A of the Terms & Conditions. You will never communicate or exchange content with anyone you know or suspect to be under 18, and will stop and report immediately if you have reason to believe otherwise.
• You will not upload Media that infringes others' rights (copyright, privacy, publicity) and you have all rights needed to grant the license in Section 2.
• You understand uploads are screened automatically and may be delayed, withheld or removed; violations may result in removal and account action.

4) Consent Management, Withdrawal & Appeals

Managing consent: You can remove specific Media at any time via the app; you may also withdraw optional off-platform marketing consent in your app Settings or by contacting us (see Section 23, Notices & Contact, in our Terms & Conditions).

Effect of withdrawal: Withdrawal stops future uses. It does not undo (a) deliveries already made to purchasers, (b) necessary retention for legal, safety, or chargeback reasons, or (c) archival backups.

Periodic reconfirmation: Finsta may prompt you to re-affirm consent periodically; failure to reconfirm may pause uploads/payouts until completed.

Depicted-person appeals: If a person claims they are depicted without valid consent, we will review under Part B of our Complaints & Content Removal Policy and, where there is disagreement, allow resolution by a neutral body.

5) Data & Safety Processing

You acknowledge and consent to Finsta processing your Media and Likeness for:

• Moderation & safety: automated scanning by third-party content-safety tools (including text and metadata analysis) and human review; age-gating & blur-previews;
• Fraud/chargeback prevention (e.g., device fingerprinting, velocity checks); and
• Compliance with applicable law and partner rules.

6) Agreements

Age & Identity

I am at least 18 and of legal majority where I live. I will complete the identity and age verification carried out by Finsta’s a third-party provider before any funds are released to me. I understand that verification is operated by the third party under its own terms and privacy policy, that it checks my identity and date of birth against a government-issued identity document and may include a facial scan or other checks determined by that provider, and that if I do not complete it I cannot receive payouts.

Ownership & Rights

I am the person depicted in the content I upload, or I hold written consent and age/ID records for any other person depicted, checked against a government-issued photo ID. I will retain those records and produce them to Finsta within five (5) business days of a request, and I understand that content depicting a person whose age or consent cannot be evidenced on request will be removed.

Consent & Media License (In-Platform)

I grant Finsta a worldwide, non-exclusive, royalty-free license to host, store, encrypt, transcode, analyze for safety, and otherwise process my images, videos, audio, text, and Likeness on the Finsta Platform, consistent with Finsta's Standards. I understand this works in two different ways:

• My non-restricted profile elements (display name/handle, avatar, banner, bio), which must be non-explicit: Finsta may display them inside the Platform, including in in-app discovery, and on Finsta's own marketing websites.
• My age-restricted Media: Finsta may deliver it, and its blurred preview, to the individual recipient who obtains it through the Platform, and will not display it on any public or general-access surface or use it in marketing.

Visibility Clarification

I understand age-restricted content is not publicly visible and will be blur-gated and accessible only to the consumer who purchases it; non-restricted profile elements may appear publicly if compliant.

Pre-Screening Acknowledgment

I understand every upload is subject to automated screening before publication, that no screening system detects every violation, and that my uploads may be delayed, restricted, or removed for safety, legal, or policy reasons.

Lawful Interactions

I am responsible for my own conduct in an Interaction. I will take reasonable steps to satisfy myself that each Interaction is lawful, and I will never communicate or exchange content with anyone I know or suspect to be under 18. If I have reason to believe the other person may be under 18, or that an Interaction may involve coercion, trafficking, or someone who cannot freely consent, I will stop immediately and report it. I understand that screening does not relieve me of this responsibility and that I remain responsible and liable for my own conduct, as set out in Section 5A of the Terms & Conditions.

Optional: Off-Platform Marketing Consent (separate, optional)

I consent to Finsta using my non-restricted images, Likeness, and display name off-platform (e.g., website, social media, paid ads) to promote me or Finsta. I understand Finsta will not use sexually explicit or age-restricted Media in off-platform marketing, and will not direct off-platform marketing to any jurisdiction where the Platform's content or services are unlawful. I can withdraw this optional consent at any time in Settings or by contacting Finsta.
